    Mission: To become the best planning organization in the State through dedication, organization, technology, and communication.


    Program Description: This program is responsible for operations of the department and administers and staffs the Maui Planning Commission, Moloka`i Planning Commission, Lana`i Planning Commission, Hana Advisory committee to the Maui Planning Commission, Board of Variances and Appeals, Maui County Cultural Resources Committee, Maui Urban Design Review Board, Maui Redevelopment Agency and Napili Bay Civic Improvement District Advisory Committee. Permits and approvals are issued for land use, zoning, coastal zone management, historic districts, building and subdivision, and miscellaneous permits. Other planning responsibilities include general and community planning, cultural resources management, data collection, census information, mapping and geographic information, and special projects.

    The Planning Director oversees administrative reviews and applications for building permits, sign permits, subdivision approvals, landscape plans, historic district approvals, and special management area minor permits. The three Planning Commissions review and act on applications for special management area permits, special use permits, accessory use permits and off-site parking approvals. The Commissions review and recommend actions for changes in zoning, community plan amendments, district boundary amendments, and conditional permits. In addition, the Commissions review and comment on all land use ordinances proposed by the director and the County Council. The Board of Variances and Appeals hears and determines appeals from the decision of any department charged with the enforcement of zoning, subdivision and building ordinances and hears and determines all other matters under its jurisdiction.

    Coastal Zone Management
    Program Description: The County of Maui implements the goals, objectives and policies of federal and state coastal zone management laws through the use of Special Management Areas, Shoreline Setback Areas, and Beach Restoration and Nourishment projects. The Planning Department regulates all development and activities within these geographic overlays to ensure that adequate access to beaches, recreational areas and coastal amenities are preserved and to avoid the permanent loss of shoreline resources. All proposed activities and/or structures within these areas are required to undergo an assessment to determine if special conditions or controls on development are required before the activity or structure is permitted. Using prescribed forms and application materials, the assessment process allows for appropriate development while balancing the competing needs of coastal conservation and public use. The assessment considers both site specific and cumulative impacts in order to prevent the foreclosure of management options that will serve the public’s interest and future generations. By applying Special Management Area and Shoreline Setback Area rules, the County of Maui ensures consistency with federal and state law and remains eligible to receive federal and state funding and technical assistance for the coastal zone management program.

  • The Maui Shoreline Atlas. The Atlas is hosted by the University of Hawaii Coastal Geology Group to provide the public an easy way to view erosion maps, however ALL questions should be directed to the Maui County Planning Department.
  • Zoning Administration and Enforcement Division
    Pursuant to the 1996 Charter Amendment which transferred the Board of Variances and Appeals to the Planning Department, a small group of workers from the Department of Public Works was transferred to the Planning Department. According to the head of the Zoning Administration and Enforcement Division, this division enforces State and County zoning ordinances. Upon adoption of the proposed sign ordinance, this division will also provide enforcement in this area. This division also provides all administrative support for the Board of Variances and Appeals. The members of each planning commission shall be residents of the island of the planning commission on which the member serves. The director of the department of public works and waste management and the director of the department of water supply shall be non-voting ex-officio members of each commission. (Amended 1992) Each planning commission shall exercise its powers, duties and functions as follows:
    1. The Maui planning commission shall be concerned with the area encompassing the islands of Maui and Kahoolawe and all other islands lying within three nautical miles of the shores thereof, and the waters adjacent thereto. (Amended 1992) The appropriate planning commission shall:
    2. Advise the mayor, council, and the planning director in matters concerning planning programs.
    3. Review the general plan and revisions thereof prepared by the planning director or at the request of the council. The commission shall hold public hearings on such plans and revisions thereof and shall transmit them, with its findings and recommendations to the council for consideration and action.
    4. Review other proposed land use ordinances and amendments thereto prepared by the director or the council and, after public hearings, transmit such ordinances with its findings and recommendations thereon to the council for consideration and action.
    5. Act as the authority in all matters relating to the Coastal Zone Management law.
    6. Adopt rules pursuant to land use ordinances or law.

      The Moloka`i planning commission shall be concerned with the area encompassing the island of Moloka`i and all other islands lying within three nautical miles of the shores thereof, and the waters adjacent thereto, except that portion of the island known as Kalaupapa, Kalawao, and Waikolu and commonly known and designated as the Kalaupapa Settlement. (Amended 1988) The appropriate planning commission shall:
    1. Advise the mayor, council, and the planning director in matters concerning planning programs.
    2. Review the general plan and revisions thereof prepared by the planning director or at the request of the council. The commission shall hold public hearings on such plans and revisions thereof and shall transmit them, with its findings and recommendations to the council for consideration and action.
    3. Review other proposed land use ordinances and amendments thereto prepared by the director or the council and, after public hearings, transmit such ordinances with its findings and recommendations thereon to the council for consideration and action.

  • Cultural Resources Commission
    MCC 2.88.010 Purpose and Intent. The council finds that preservation of historic properties enhances the educational, cultural, economic and general welfare of the County. It is deemed essential that the qualities relating to the history and culture of Maui County be preserved through comprehensive historic preservation planning. Implementation of chapter 6E, historic preservation, HRS, Maui County general plan and the adopted community plans provide a means to perpetuate the value of various cultures of which our community is comprised.

    Urban Design Review Board
    MCC 2.26.040 Powers and duties.
    1. The board shall advise the appropriate planning commission on matters within the jurisdiction of the planning commission and shall carry out such duties as may be delegated to it by the appropriate planning commission or as provided by law.
    2. The board may review and advise the planning department on design related matters involving projects within the County.
    3. The board, upon dissolution of the urban design review board, shall review project plans in accordance with the provisions of the special management area rules and regulations of the appropriate planning commission.
    4. The board shall adopt rules of practice and procedure, pursuant to chapter 91, HRS.
    Board of Variances and Appeals.
    Charter Section 8-8-7. The board of variances and appeals shall consist of nine members appointed by the mayor with the approval of the council. In accordance with such principles, conditions and procedures prescribed by the council, the board of variances and appeals shall:
    1. Hear and determine applications for variances from the strict application of any zoning, subdivision or building ordinances. The board shall hold a public hearing prior to ruling on a variance application and shall issue findings of fact and conclusions of law on decisions granting or denying variance applications.
    2. Hear and determine appeals alleging error from any person aggrieved by a decision or order of any department charged with the enforcement of zoning, subdivision, and building ordinances; provided, that the council may by ordinance confer to another County agency the authority to hear and determine appeals from the decisions of the building official in the administration of the County of Maui building code, plumbing code, electrical code, and housing code, and from any order made by the County fire chief in the administration of applicable State law and the County of Maui fire code, and the director of water supply in the administration of the rules and regulations of the department of water supply relating to matters involving any denial of the use of new or alternate materials, types of construction, equipment, devices or appliances.
    3. Hear and determine all other matters which the board may be required to pass on pursuant to ordinances.
    4. Adopt rules of procedure for the conduct of the board's business. (Amended 1996)
    Maui Redevelopment Agency
    HRS 53-5. Powers and duties of agency.
    1. To undertake and carry out urban renewal projects and related activities authorized by this chapter; to make and execute contracts and other instruments necessary or convenient to exercise its powers under this chapter; to sue and be sued; to have a seal and, subject to any limitations in this chapter contained, to exercise all powers necessary, incidental, or convenient to carry out and effectuate the purposes and provisions of this chapter.
    2. To make, amend, and repeal rules and regulations not inconsistent with this part to carry into effect the powers and purposes thereof, which rules and regulations shall be subject to chapter 91.
    3. To appoint a manager and a deputy manager.
    4. To make preliminary surveys, studies, and plans to identify redevelopment areas; provided that the studies and initial determination of what areas are blighted, within the meaning of this part, shall be made exclusively by the planning commission, and to make redevelopment plans for the areas, which plans shall be in conformity with the master plan for the development of the locality, and each plan shall show the outline of the area, character of existing development, proposed use of land, general character of new buildings and other general details of redevelopment, as well as the preliminary estimated cost thereof. Further, the plans shall give due consideration to the provision of adequate park and recreational areas and facilities that may be desirable for neighborhood improvement with special consideration for the health, safety and welfare of children residing in the general vicinity of the site covered by the plans. In preparing redevelopment plans the agency shall utilize such assistance as can be given by employees of the government, but may also enter into contracts for professional services in connection therewith. Any council which is not otherwise authorized to establish a planning commission with power to prepare a master plan for the physical development of the locality, may prepare such a master plan for the purposes of initiating and carrying out a redevelopment project under this part.
    5. To assist and cooperate with other local agencies within the State and to contract for professional services with the other local agencies in carrying out its duties.
    6. To establish and operate a central relocation office which shall perform such functions and activities as may be necessary and proper for the satisfactory relocation of families, individuals, businesses, and nonprofit organizations, incorporated and unincorporated, displaced by any governmental action to decent, safe, and sanitary locations at rents and prices within the financial means of the displaced families, individuals, businesses, and nonprofit organizations. To the extent that special funds are made available by the State or the county, the agency may authorize the central relocation office to make relocation payments for actual moving costs to families, individuals, businesses, and nonprofit organizations, incorporated or unincorporated, displaced from other than urban renewal projects; provided that the payments shall not exceed $100 for each displaced family or individual and $300 for each displaced business (including the operation of a farm) or nonprofit organization; provided further that the payments shall not be made to recipients of any other relocation payments made by any government or agency thereof for the same displacement. In the case of a business, the allowable expenses for transportation shall not exceed the cost of moving fifty miles from the point from which the business is being displaced. To prepare plans for and assist in the relocation of persons (including individuals, families, business concerns, nonprofit organizations and others) displaced from an urban renewal area, and to make relocation payments to or with respect to the persons from funds provided by the federal government.
    7. To prepare a general neighborhood renewal plan for urban renewal areas which may be of such scope that urban renewal activities may have to be carried out in stages over an estimated period of up to ten years. The plan may include, but is not limited to, a preliminary plan which (A) outlines the urban renewal activities proposed for the area involved, (B) provides a framework for the preparation of urban renewal plans, and (C) indicates generally the land uses, population density, building coverage, prospective requirements for rehabilitation and improvement of property, and portions of the area contemplated for clearance and redevelopment. A general neighborhood renewal plan shall, in the determination of the local governing body, conform to the general plan of the locality as a whole and the workable program of the county.

    Hana Advisory Committee to the Maui Planning Commission
    MCC 2.28.060 Hana advisory committee. Powers, Duties, and Functions. The Hana advisory committee shall advise the Maui Planning Commission on matters within its jurisdiction and shall carry out such duties as may be delegated to it by the Maui Planning Commission.

    Napili Bay Civic Improvement District Advisory Committee
    MCC 19.34.030 ...The duties of the advisory committee are as follows: No building permit shall be issued for any new building or structure or for the remodeling of the exterior of any building or structure in any civic improvement district heretofore or hereafter established unless or until approval therefor has been given as follows:
    1. The applicant shall submit plans of the proposed building or structure or the remodeling of an existing building or structure to the planning director. The planning director shall then transmit such plan and other data as may be required to the advisory committee. The committee shall inspect such plans so as to determine whether such plans comply with the standards as to design and location specification in the precise plan of the civic improvement district in which the property is located. Approval of review of the plan so submitted shall take place within thirty days from the date of filing with the planning director, unless a longer period is agreed upon with the applicant.
    2. The committee shall present its findings to the board of adjustment and appeals which shall thereupon take necessary and appropriate action. Any action of the board of adjustment and appeals, whether granting or denying the precise plan for civic improvement district, shall be referred to the council for its approval. The council may override such action of the board of adjustment and appeals and either grant or deny the precise plans, as the case may be, by an affirmative vote of a majority of the members of the council.
